Jessica Vella Art & Design Studio provides online products and services (“Products”) and (“Services”) to you (“you” or “the Client”). The Products include the sale of Products and Services at standard prices, whereby the trader provides the Products and Services subject to the following terms and conditions (“Terms”). You are accepting these Terms in order to receive the Products.
BY REGISTERING FOR AND USING THE PRODUCTS AND SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS AND ALL POLICIES AND GUIDELINES. PLEASE READ THIS DOCUMENT CAREFULLY BEFORE ACCESSING OR USING THE SITE. BY ACCESSING OR USING THE SITE, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS SET FORTH BELOW. IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS AND CONDITIONS, YOU MAY NOT ACCESS OR USE THE SITE. JESSICA VELLA ART & DESIGN STUDIO MAY MODIFY THIS AGREEMENT AT ANY TIME, AND SUCH MODIFICATIONS SHALL BE EFFECTIVE IMMEDIATELY UPON PUBLISHING OF THE MODIFIED
AGREEMENT ON THE SITE. YOU AGREE TO REVIEW THE AGREEMENT PERIODICALLY TO BE AWARE OF SUCH MODIFICATIONS AND YOUR CONTINUED ACCESS OR USE OF THE SITE SHALL BE DEEMED YOUR CONCLUSIVE ACCEPTANCE OF THE MODIFIED AGREEMENT.

1. Eligibility
You are eligible to register on the Jessica Vella Art & Design Studio’s website and use the Services if you may enter into legally binding contracts for the purchase of goods or services under applicable law. Persons under the age of eighteen (18) may not use the Services and may not register. Prior to providing you the Services, Jessica Vella Art & Design Studio may require that you provide a valid credit card number, billing address, and credit card expiration date or other form of payment. OBTAINED THROUGH THE SITE. BECAUSE SOME COUNTRIES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR
CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IN SUCH COUNTRIES, JESSICA VELLA ART & DESIGN STUDIO; STUDIO DESIGN´S LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW. REPRESENTATIONS OR ENDORSEMENTS WHATSOEVER (INCLUDING WITHOUT LIMITATION WARRANTIES OF TITLE OR NONINFRINGEMENT, OR THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE) WITH REGARD TO THE SITE, ANY MERCHANDISE INFORMATION OR SERVICE PROVIDED THROUGH THE SITE OR ON THE
INTERNET GENERALLY, AND JESSICA VELLA ART & DESIGN STUDIO SHALL NOT BE LIABLE FOR ANY COST OR DAMAGE ARISING EITHER DIRECTLY OR INDIRECTLY FROM ANY SUCH TRANSACTION. IT IS SOLELY YOUR RESPONSIBILITY TO EVALUATE THE ACCURACY, COMPLETENESS AND USEFULNESS OF ALL OPINIONS, ADVICE, SERVICES, MERCHANDISE AND OTHER INFORMATION PROVIDED THROUGH THE SITE OR ON THE INTERNET GENERALLY.
Jessica Vella Art & Design Studio makes no representations whatsoever about any other website which you may access through this one or which may link to this Site.
6. Indemnification
You agree to indemnify, defend, and hold harmless Jessica Vella Art & Design Studio, its officers, employees, agents, licensors, suppliers and any third-party information providers to the Site from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of this Agreement (including negligent or wrongful conduct) by you or any other person accessing the Site.

7. Third-Party Rights
The provisions of paragraphs 4 (Use of the Site), and 6 (Indemnification) are for the benefit of Jessica Vella Art & Design Studio and its officers, employees, agents, licensors, suppliers, and any third-party information providers to the Site. Each of these individuals or entities shall have the right to assert and enforce those provisions directly against you on its own behalf.

Our written and spoken languages are English and Maltese. Should you wish to receive support and be contacted please use the Contact Form or send us an email and provide a phone number and description of your query and we will get back to you either via email or phone (kindly advise your preferred method of communication).

9. Miscellaneous
This Agreement shall all be governed and construed in accordance with the laws of Malta applicable to agreements made and to be performed in Malta. You agree that any legal action or proceeding between Jessica Vella Art & Design Studio and you for any purpose concerning this Agreement or the parties’ obligations hereunder shall be brought exclusively in a court of competent jurisdiction sitting in Malta. Any cause of action or claim you may have with respect to the Site must be commenced within one (1) year after the claim or cause of action arises or such claim or cause of action is barred. Jessica Vella Art & Design Studio´s failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement. Jessica Vella Art & Design Studio may assign its rights and duties under this Agreement to any party at any time without notice to you. Any rights not expressly granted herein are reserved.
10. Kids' Privacy
We do not address anyone under the age of 18. We do not knowingly collect personally identifiable information from anyone under the age of 18. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 18 without verification of parental consent, we take steps to remove that information from Our servers.
11. Changes to our Privacy Policy
We may change our products and services and policies, and we may need to make changes to this Privacy Policy so that they accurately reflect our products and services and policies. Unless otherwise required by law, we will notify you (for example, through our Product and Service) before we make changes to this Privacy Policy and give you an opportunity to review them before they go into effect. Then, if you continue to use the Product and Service, you will be bound by the updated Privacy Policy. If you do not want to agree to this or any updated Privacy Policy, you can delete your account.
12. Governing Law and Consumer Affairs Act
These terms and conditions shall be subject to and governed by Maltese law. Any disputes, claim or controversy arising out of or in connection with this Agreement, shall be or the breach, termination or invalidity thereof, shall be settled to the exclusion of the ordinary courts, by arbitration in accordance with The Consumer Claims Tribunal (CCT) of the Consumer Affairs Act (Chapter 378 of the Laws of Malta) in accordance to the procedure laid out by the same act (visit https://mccaa.org.mt/tribunal).
13. Your Suggestions
Any feedback, comments, ideas, improvements, or suggestions (collectively, “Suggestions”) provided by you to info@jessicavella.art with respect to the website shall remain the sole and exclusive property of Jessica Vella Art & Design Studio. Jessica Vella Art & Design Studio shall be free to use, copy, modify, publish, or redistribute the Suggestions for any purpose and in any way without any credit or any compensation to you.
